In processing the personal data of its Users, the Data Controller complies at all times with the legislation in force in Portugal, in particular with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (hereinafter referred to as "GDPR"), as well as with Law No. 58/2019, of 8 August, which ensures the implementation, in the national legal system, of the GDPR.

The responsible party exclusively processes personal data provided by the user and does not process special categories of personal data. The main purpose for which we process User information is to provide the services expressly requested by the User (marketing and offers related to perfumery, beauty and cosmetic products).

The Responsible Party processes user data for the following purposes:

Provision of services expressly requested by the User, as well as managing their payments and orders;

Providing support services to Users, notifying them of service or account problems (e.g., resetting passwords, warning about inappropriate conduct, and, if necessary, informing them of the suspension or deletion of their User account);

Conducting commercial, operational, and statistical activities. No automated decisions will be made based on this profile.

Sending and forwarding newsletters and other commercial communications by email about the Manager. The User may indicate their opposition to receiving such newsletters at any time. The User expressly consents to receiving these emails, although they may unsubscribe (i) via the link specified in any email communication, (ii) by sending an email to info@bru.fashion. However, this does not mean the cancellation of certain non-commercial communications, such as messages related to their account.

The legal basis for the processing of User data by the Controlling Party is the User's consent (Article 6, paragraph 1, point a) of the GDPR). Subsidiarily, the Controlling Party may process User data based on legitimate interest (Article 6, paragraph 1, point f) of the GDPR), in particular for direct marketing purposes, provided that such interest does not override the User's fundamental rights and freedoms.

The provision of personal data by the User is voluntary, although it constitutes a contractual condition for the User to purchase products marketed by the Controlling Party. Thus, the User's refusal will mean the inability to provide certain services to the User by the Controlling Party.

The User may withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

The Data Controller will always request consent and inform the User before using their data for any purpose other than those described in this Privacy Policy.

Recipients of personal data

The Data Controller will communicate the User's personal data to the following recipients, which the User expressly accepts:

Anonymously, to advertising and programming providers to share statistics;

Data processing supervisors who provide certain services to the Data Controller (advertising, administrative-accounting, etc.).

Data retention period

The personal data provided will be kept indefinitely, unless the User requests its deletion.

Other user rights

The user can obtain confirmation as to whether the controller is processing personal data relating to him or her and access it.
The User may request the Controller to exercise the rights of access to personal data, rectification, erasure, restriction of processing, objection and portability by sending an email to info@bru.fashion, attaching a copy of the User's official identification document and clearly stating the right that you wish to exercise. You can request the forms for exercising the aforementioned rights from this email address.

The user may also file a complaint with a supervisory authority.

Privacy of minors

The data controller addresses adults and does not voluntarily collect or maintain personal data from minors. If the controller becomes aware that the user is a minor, they will immediately cancel their personal data and account.

Security measures adopted by the controller to ensure data confidentiality

The Data Controller adopts the necessary technical and organizational measures to prevent loss, misuse, alteration, unauthorized access, and theft of personal data provided, as well as to ensure a level of security appropriate to the risk, taking into account the state of technology, application costs, nature, scope, context, and purposes of the processing, as well as risks of varying probability and severity for the rights and freedoms of natural persons.

In using the User's personal data, the Data Controller undertakes to respect confidentiality and use it in accordance with the purpose of its processing, as well as to fulfill its obligation to maintain it and adopt all technical and organizational security measures to ensure a level of security appropriate to the risk.
The Manager takes into particular account the risks presented by data processing, in particular as a result of accidental or unlawful destruction, loss or alteration of personal data transmitted, stored or otherwise processed, or unauthorized communication of or access to such data.

The Controller takes measures to ensure that any person acting under its authority and having access to the User's personal data may only process the data following the Controller's instructions, unless required to do so by applicable law.

The user is informed that during customer registration they can approve receiving a newsletter sent to the indicated email address.

By accepting and submitting the form, the user (hereinafter “the User”) accepts and consents that the entity thebrandmakers, Lda, with registered office at Rua monte da Bela n. 270 4445-294 Valongo, Portugal, may process their personal data for the sole purpose of evaluating and, where applicable, responding to queries requested by the Responsible Party's support department, based on the consent freely given by the User (Article 6, paragraph 1, point a) of the General Data Protection Regulation).
The Professional may contact the Manager at any time by sending an email to info@bru.fashion and in writing to its registered office.
The user may withdraw their consent at any time, although this will not affect the legality of the processing based on the consent prior to its withdrawal.

The User's personal data will be processed exclusively by the Controller, the recipient thereof, who will keep the processed personal data for the period of time necessary to fulfill the specific purpose for which it was processed, proceeding to delete said personal data within THIRTY (30) days from the fulfillment of said purpose, unless the user has given his or her consent for a different purpose. The Manager will not transfer the data to any third natural or legal person.
The user may lodge a complaint with a supervisory authority and exercise the rights of access, rectification, erasure, objection, restriction of processing or portability of his or her data.
The Manager does not make automated decisions on the user's data.

Professional Consents

By accepting and submitting the form, the user (hereinafter “the Professional”) accepts and consents that the entity thebrandmakers, Lda, with registered office at Rua Monte da Bela n. 270F 4445-294 Valongo, Portugal, and Tax Identification Number PT518851273 (hereinafter “the Controller”), may process their personal data for the sole purpose of evaluating and, if applicable, establishing commercial relations with the Professional, on the legal basis that the processing is necessary for the application, at the Professional's request, of pre-contractual measures (Article 6(1)(b) of the General Data Protection Regulation).

The Professional may contact the Manager at any time by sending an email to info@bru.fashion or in writing to its registered office.

The Professional's personal data will be processed exclusively by the Controller, the recipient of said data, who will retain the personal data being processed for the period of time essential for compliance with the legal and tax obligations applicable to the Controller. The Controller may also transfer this data to third parties with whom it has a commercial relationship and to other companies within the group to which the Controller belongs, for administrative purposes, based on the legitimate interest of both parties (Article 6, paragraph 1, point f) of the GDPR).
The Professional may lodge a complaint with a supervisory authority and exercise the rights of access, rectification, erasure, objection, restriction of processing or portability of their data.
The Controller does not make automated decisions regarding the Professional's data.
